    NINE YEARS OF MURDER. A GANG OF SILOVIKI AND VETERANS

    Each criminal group outnumbered competitors in some particular type of activity. Someone was not bad at organizing fraudulent schemes and was actively involved in extortion. Someone skillfully committed robberies, while managing not to arouse suspicion on the part of the law and order. And the Gagiev’s gang, operating in North Ossetia, became famous as the organizer of the loudest and most brutal murders.

    WHO IS GAGIEV?

    Aslan Gagiev is known in the underworld as «Jaco». According to official documents, his second name is Sergey Morozov. The future criminal was born in North Ossetia on February 5, 1970, where he lived all his life. Nothing is known about the childhood and youth of this person. In modern life, he became famous as the most brutal murderer, on whose account more than 60 victims.

    THE HISTORY OF THE CREATION OF THE GANG

    Gagiev made the decision to create a gang in 2004. At the same time, he began organizing a strict selection of participants. The group included only cruel and cold-blooded male killers, who aroused the trust of «Jaco». At first, the purpose of the gang was to protect their own interests. Aslan Gagiev had several projects of his own, in which he was successful. The young entrepreneur used the services of contract killers to solve commercial problems and eliminate competitors. Later, they carried out murder orders, making good profits. At first, they operated strictly on the territory of North Ossetia, and then took orders in Russia. In several firms, the killer acted under a false name — Sergei Morozov. However, this is far from all the achievements of the most brutal group. They also developed various fraudulent schemes that brought them millions of dollars.

    GANG STRUCTURE

    The head of the gang was its organizer — Aslan Gagiev. The entire powerful indestructible group, which numbered about 40 people, was divided into several divisions. The most important part, which was taken for the most difficult murders, was headed by the leader’s namesake — Oleg Gagiev. In the criminal world, the man acquired the nickname «Bote», which means «Baby» in Ossetian. He is a native of South Ossetia, for several years he was on the staff of the South Ossetian counterintelligence. In addition to him, two police officers, one prosecutor and several participants in the 1992 war with Georgia became members of the group. First, the gang organized its activities in North Ossetia, then, it acquired its own base in Moscow, where meetings were held and plans for the future were discussed. Alexander Dzhussoev became Oleg Gagiev’s deputy. The right hand got the role of transferring orders from the leader to the killers. To do this, he regularly flew from Vladikavkaz to the main base located in Moscow.

     

    THE INGREDIENTS FOR SUCCESS

    Until now, Gagiev’s gang is known as one of the most successful in Moscow and North Ossetia. For 9 years, its participants unconditionally accurately coped with each order, and there was no equal to them in this matter. To calculate the victim, the killers used fake SIM cards, fake documents, stolen vehicles registered in someone else’s name, and they also rented several apartments throughout the city in various localities. They acquired weapons in South Ossetia. Only an experienced first-class hitman was allowed to work. All this helped Gagiev’s gang to commit murders and remain unpunished.

     

    THE LOUDEST CRIMES

    The first serious cause for concern among law enforcement officials appeared at the end of 2003. At the dawn of the founding of the group, Oleg Gagiev’s wards committed three brutal murders. A criminal case was opened, an investigation was conducted for a long time, but the guilt of the criminals was never proven. Years later, Gagiev’s gang became famous not just as ruthless killers, but as murderers who commit the most notorious crimes, discussed in large quantities. Only in 2008, members of this group killed the rector of the Vladikavkaz higher educational institution Sergei Takoev, the heads of two departments of the Ministry of Internal Affairs Mark Metsaev and Vitaly Cheldiev, police major Ilya Kasradze, the mayor of Vladikavkaz Vitaly Karaev and the former mayor Kazbek Pagiev. In one word, everyone who sought to hinder the development of the killers’ activities fell under execution.

     

    END OF ACTIVITY

    For almost 9 years, the gang managed to commit high-profile crimes. For several weeks, the killers were placed in a pre-trial detention center, but later they were released because no evidence of the crimes could be found. Later it turned out that the killers also had a serious cover in the law enforcement agencies, which “excused” them from possible punishment. But, at the end of 2012, the investigative committee still managed to expose 5 members of Gagiev’s gang, including deputy head Alexander Dzhussoev. All of them were arrested and sentenced to the punishment they deserve. A lengthy investigation revealed the involvement of Oleg Gagiev in organizing the crimes. By a court decision, he received the most severe punishment — life imprisonment and a fine of 1 million rubles. Three years later in 2015, 6 more gang members were arrested. Each of them was sentenced to a long term — from 16 to 22 years.

     

    FOUNDER’S FATE

    Literally immediately after the investigation began, the founder of the group of brutal killers, Aslan Gagiev, managed to escape so that from 2012 to 2015, for 3 years, he could not find anyone. Perhaps he used false documents, since his gang was quite successful in their execution. The organizer of the group was put on the international wanted list. It was still possible to find him in Vienna; he was detained by local law enforcement officers in January 2015. The native of North Ossetia was accused of organizing a criminal gang and committing numerous murders. For about 3 years he was in a prison located in Austria, but was later released on bail, paying 100 thousand euros. Over the years, the best lawyers from his homeland fought for his fate, trying to prove him right, but all these attempts were unsuccessful. In order to achieve release, they provided the police with a certificate of aerophobia, which made it possible to postpone his flight home for a certain time, and Aslan Gagiev himself sought to achieve refugee status, referring to the fact that he was a participant in hostilities. In June 2018, he was nevertheless extradited to the Russian Federation.

    At present, an investigation is underway on him, as well as on 16 other members of the group, one can only guess about its results. Until now, such a brutal group of bandits as the Gagiev’s gang has not yet been known, which was able to kill dozens of high-ranking officials and at the same time remain unpunished for a long time.     Novaya Gazeta journalist Roman Anin managed to meet and talk with Gagiev in Vienna before his extradition. Gagiev is very popular in Ossetia, where he is called Big Brother. He participated in the rescue of hostages at a school in Beslan in 2004 and fought on the side of South Ossetia in the war with Georgia in 2008. According to the investigation, in 2004 Gagiev created a «criminal community». The members of this community called themselves «Family» and each other — «brothers». They believed that they were doing a good deed, killing «villains who prevent ordinary people from living.» For example, they killed members of a criminal gang that kidnapped people. The leader of this group was the brother of the former Deputy Minister of Internal Affairs of North Ossetia. But at the hands of the «brothers» not only kidnappers died, but also officials of North Ossetia; Absolutely random people also became victims of the «Family»; There were also those who were killed because of a financial showdown. The «Family» consisted of many members of law enforcement agencies, including special forces, criminal investigation officers and an employee of one of the most secret divisions of the Ministry of Internal Affairs.

    Gagiev and members of his «Family» were associated with a huge number of the highest-ranking officials and their relatives: With the sister of the Deputy Minister of Industry of Russia, With the head of one of the most important departments of the TFR, With the former prosecutor of the Leningrad region, With the top leadership of North Ossetia, With an employee of the Presidential Administration of Russia. And the existence of the «Family» was ensured, among other things, at the expense of the state «Financial Leasing Company» (FLC). In 2010, disagreements began in the «Family», and the «brothers» began to kill each other. Someone was detained by law enforcement officers. Some received life sentences, while others, like Gagiev, are currently awaiting trial.

     

    CHAPTER I

We met with Gagiev at the permanent mission of North Ossetia in Moscow. After that, we saw each other several times. And, in my opinion, the people with whom he came to negotiations, then the competition and won. He made a good impression. He spoke logically, behaved in a businesslike manner.

    One got the impression that he was worried about the republic, about the state in which the people lived ”. “I heard from people who suffered in Beslan that he was helping them. And in South Ossetia, people said that he helped them when there was a war with Georgia. I was surprised when I saw publications about his other side of life. It said, among other things, that he ordered an attempt on my life. » “Both then and now I hardly believe that Gagiev was really involved in this. But, I repeat, we saw each other only 3-4 times. Alexander Totoonov, the first deputy chairman of the North Ossetian parliament, also denies a «close relationship» with Gagiev. “This person was not a member of my close circle, one of my friends or comrades. And even more so, no common affairs connected me with him. Several years ago, a «sensational» headline appeared in social networks about my alleged involvement in this story. But even then, the anonymous authors of the article could not give a single argument. Because there really are none.

    You see, Ossetia is such a small republic that all residents can have common acquaintances or intersect at some events, without even knowing each other. Therefore, insinuations on the topic of imaginary intimacy with someone are possible, as well as in relation to any other representative of an equally small people. In this case, this is nothing more than a provocation, which, I admit, may be beneficial to my political opponents. I have never attached much importance to such phenomena. However, I am grateful for your interest and I will add that you are the first journalist who asked for my comment on this matter. «, — Totoonov told Novaya Gazeta. But the list of officials drawn up by the Interior Ministry operatives is very short, and most importantly, modest. It does not contain the names of those who were really connected with the group, and above all financially. As a result of its own investigation, Novaya Gazeta succeeded in expanding the list of officials significantly: for example, the head of one of the most important departments of the Investigative Committee of Russia; Deputy Minister of Industry; an officer of a top-secret division of the Ministry of Internal Affairs and many others.

    Gagiev’s private history tells about the great history of the country. On the example of this case, the motives and characters of those who have been at the head of the state for the last 20 years become absolutely clear. This story is not about one grouping, but about the system that took shape in Russia at the beginning of the 21st century. Extradition or death After the first meeting, we saw Big Brother several more times in Vienna and agreed that I would write about him if one of two conditions was fulfilled: either he would be killed or extradited (which for him, who survived torture in a Russian prison, was equivalent) … And then one of the conditions worked. And yet I cannot describe everything that we discussed. For many reasons.

    First, because most of what has been told cannot be documented. Secondly, because many of the events that we discussed will soon become the subject of consideration in court, I have no right to help any of the parties. Therefore, in this investigation I will cite only those words of Gagiev that characterize him as a person and cannot be used in court to admit his guilt or, conversely, to justify him. Although I have already heard several times from “interested persons” the opinion that there will be no trial, at least for Gagiev himself. They say that the number of high-ranking people is so large — those who once went to him for protection, for money, for moving up the career ladder — who today want to solve Gagiev’s problem «in an informal way» (thus, for which they are going to judge him) … I don’t know how close these assumptions are to the truth, but one of the goals of this text is to try to exclude such a possibility and name those who will never be summoned to court, let alone put on trial. In this investigation, I will deliberately rely only on the information that was verified using open sources or materials from criminal cases, as well as on the testimony of Aslan Gagiev himself to the Austrian court, which was deciding on the extradition issue. Someone previously posted these testimonies in the public domain. And, perhaps, it is worth starting with the biography of Gagiev, told by him.

     

    CHAPTER II

    In which Gagiev saves his family from nationalists in Georgia; frees hostages in Beslan; is tortured by the FSB and creates a «Family» of «brothers» Escape from Georgia “My family lived in Georgia. The nationalist Gamsakhurdia came to power in Georgia. I am Ossetian, in Georgia we were a minority. Ossetians were persecuted, I was still a student then and wanted to take my family «- said Gagiev in the Austrian court when the issue of extradition was being decided. In those days, he was a student at the Moscow Civil Engineering Institute (MISS). “I went there. I gathered about 40 people and it took us two weeks to get there. All my relatives were with me. My father’s brother was killed during the persecution, and it took us two weeks to walk to Russia. There was no transport. A two month old baby — my sister’s baby — died on the way in my arms. We came to the territory of the Russian Federation, it was North Ossetia, and settled there in an abandoned house «- Gagiev continued his story. And since then, the fate of Gagiev has been firmly connected with the historical events of both Ossetia. And above all with tragedies.

    But the hostage-taking at a school in Beslan in 2004 seems to have played a special role in his fate. This terrorist attack claimed the lives of 333 people, including 186 children. I dropped my machine gun, and the child was at my fingertips. I tried to lift the girl, but nothing came of it. There were explosions, shooting, and I tried to raise the child, but nothing worked. Then I noticed that the girl was holding tightly to her dead mother. The mother was torn to pieces. So I had to practically carry the girl and her dead mother «, — Gagiev told the Austrian judge. Apparently you were doing hostage rescue there, is that correct? the judge asked. Yes. Everyone did this with us, this has never happened before. Were you a police officer? Have you held a public office? Why did you free the hostages armed with a machine gun? It really was chaos. You say that you mainly lived in Moscow, how do the conflicts occurring at a distance of 2000 kilometers from Moscow concern you? the Austrian judge asked a little later. The tragedy in Beslan changed my life. I felt guilty and wanted to be close to my people. I wanted us to become a free nation. After the tragedy in Beslan, Gagiev became famous among his compatriots.

    According to him, he earned this popularity, among other things, by asking uncomfortable questions to the authorities about material assistance to the relatives of the victims. And then, judging by his testimony, he had a serious conflict with the federal center. Abduction and torture About a month after the terrorist attack in Beslan, Aslan Gagiev was detained. “Then there were reports in the media that a lot of donations were received in the republic. Many people from all over the world donated. The republic received about 600 million euros. Then I wondered where the donated money was and why people cannot bury their children with this money … Then the population of the republic gathered, and we went to the president and demanded the resignation of him and the head of the special service «- Gagiev explained to the Austrian judge the reason for his conflict with the authorities. And then, as he was driving to his parents’ house in Beslan, his car was blocked by people wearing masks. «It was the FSB, namely the service responsible for constitutional order»- he said. They started shooting in the air, dragged him out of the car, put him in their jeep and took him to the local FSB headquarters. “I will only briefly outline what happened to me. All internal organs were torn apart, several operations were required, » Gagiev spoke. After 5 days, half-dead, he was taken to the border with Kabardino-Balkaria and thrown out of the car naked. Then he flew to Israel, where he underwent surgery and underwent psychological rehabilitation. Gagiev’s testimony about torture was checked by experts, and his words were confirmed. “The expert opinion of prof. (Many of them later stated that they had given these statements under torture and therefore retracted them.) They all said about the same thing, only the names of the victims and the methods of murder differed. They called themselves «Family». Each member of the «Family» was a «brother», and Gagiev was called Big Brother or Big Brother. Within the «Family» there were subgroups («brigades», as the investigation calls them), each with its own leader. “No one gave any oaths to anyone to join the Family and eternal devotion.

    At one point, Gagiev and Beglaryan declared everyone to be «Family» and «brothers». Subsequently, those who came to the «Family» shook his hand and declared him «brother», — recalled during interrogations one of the longtime members of the «Family» Goneri Dzhioev. The «brothers» were given money to buy clothes, purchase cars, rent apartments, medical treatment, education and much more. They had at their disposal an almost unlimited arsenal of weapons, including those used only by the special services. These weapons were mainly purchased in South Ossetia. Leaving the «Family», as well as any actions directed against the «brothers» or the interests of the «Family», were punishable by death, the detainees said. Most of the members of the «Family» were Ossetians, they joined it voluntarily and were sure that they were acting for the good of their homeland. They said in their testimony that Gagiev is an influential person in Moscow, worries about the well-being of North Ossetia and wants to restore order in it, cleanse it of bad people, and to fight the villains he needs real patriots. They understood that sometimes the «villains» would have to be killed, but this was justice in their mind. Indeed, many victims of the «Family» were people who themselves were engaged in murders and abductions. But they weren’t the only ones killed. There were also casual victims, and there were those who died due to financial disputes. And among the «brothers» were not only the patriots of Ossetia, but also numerous law enforcement officers who were guided by completely different motives.

     

    CHAPTER III

    In which special forces officers of the Ministry of Internal Affairs and a classified police officer who loves to kill people and dismember corpses come to the «Family» «Fighter» against organized crime Evgeny Yashkin fought in the North Caucasus, was awarded the Order of Courage. He joined the Family in 2004 when he was 36 years old. At that time, Yashkin was an employee of the Department for Combating Organized Crime (UBOP) in the South-Western District of Moscow. Gagiev was introduced to him as businessman Valery Nikolaevich (Big Brother had several passports with fictitious names). Yashkin said that «Valery Nikolaevich» offered him to earn money for 30-40 thousand rubles a month in his personal security, as well as accompany the transportation of documents and goods. Basically, Yashkin was used as a driver, because the license allowed you to transport anything you wanted without fear of checks from colleagues from law enforcement agencies. Yashkin himself admitted that, in fact, he gave tacit consent to join the «Family» when he took part in the first crime — the kidnapping and subsequent murder of the owner of the National Capital bank Dmitry Plytnik.

    Judging by the testimony of Yashkin and other «brothers», this murder had no patriotic motives. Yashkin said that at the end of 2004, he witnessed a conversation in a car between Gagiev and his friend, who asked Big Brother to punish one person: this person «threw» him, and even arranged surveillance. Gagiev agreed to help and protect his friend. Dmitry Plytnik was kidnapped near his house. The “brothers” disguised as law enforcement officers attacked him, handcuffed him and brought him to the base on Lodochnaya Street in Moscow. Boat, house 3, building 7, view from the shore Yashkin did not see how Plytnik was killed. But when he arrived at the base, a Ford minibus was already parked in the yard with the banker’s body in it. He was told «to get behind the wheel of the said car, because he had a police officer’s ID, and in the event of a stop, upon his presentation, they could pass without hindrance, take out the corpse and drown him in a pond in open water.» So they did: the body of Plytnik was thrown into the Volga near the city of Dubna, Moscow region. After this first crime, Yashkin took part in about 25 more murders.

    Special forces officers of the Ministry of Internal Affairs The “brothers”, disguised in the uniform of police officers (and many did not even have to change, they were special forces officers), seized four people, drove to the side of the road, brought them down into the ravine and shot them down, and then burned them … «Novaya Gazeta» After Yashkin became a member of the «Family», he went to serve in a special rapid reaction unit (SOBR) of the Main Directorate of the Ministry of Internal Affairs of Russia for the Moscow region. Then the «brothers» overtook the front car and blocked it. Nikolaev and Beglaryan got out of the car and shot the Slesarevs’ family from a distance of about 10 meters. The banker, his wife and their 15-year-old daughter were killed. Seven-year-old Sophia was wounded in the chest, but fortunately survived. Nikolaev was 23 years old when he committed this massacre. But do not think that the Pioneer was an exception to the rule or a kind of «system waste». His colleagues, «tramps» from the same top-secret division of the Ministry of Internal Affairs, also worked for other criminal groups and also repeatedly participated in high-profile murders. And in January 2008, Yurtov was instructed to stand in front of a car wash near the Garden Ring and watch when a car with certain numbers entered it. The car that was being followed drove into the car wash, and Yurtov called Pioneer on the secret phone. Immediately after that, the Chrysler of the Family drove up to the sink, and the “brothers” jumped out of it in the uniform of police officers, in balaclavas masks and with dummies of Kalashnikov assault rifles. Together with Lasha, they took his friend named Gruzin — he simply turned out to be in the wrong place and at the wrong time. Both were first taken to the office of the state-owned Financial Leasing Company (FLC) on Makarenko Street in Moscow. “At Lasha they were interested in the circumstances of the abduction of Zasseev’s son Ludwig.     According to Robson, after Lasha confessed everything, he and Gruzin were taken to a distant base near the Sheremetyevo airport. Nikolayev and Beglaryan directly cut the corpses into pieces, the rest helped to hold the body parts, put them in plastic bags like garbage bags. For the convenience of cutting, something wooden was placed under the parts of the corpses — either boards or a beam, they were cut in such a way that first they chopped off the head, then the hands, part of the arm to the elbow, then to the shoulder, feet, then the leg to the knee, then to the pelvis , the body itself was not chopped into pieces. Safronov was constantly worried that the walls would be stained with blood. All this was done at night. Before dismembering the corpses, all things were removed from them, all documents were taken out of their clothes. Safronov got rid of things, burning them in a bathhouse in a furnace or on the territory of the base.

    Korotkov died in 2015 at the age of 69. “Korotkov and Zhukova met while serving in the investigation department of the Main Military Prosecutor’s Office (GVP) back in the 1980s. Korotkov was an investigator, and Zhukova worked first as a secretary, and then became the head of the secret department. All classified materials passed through it. In the early 90s, Korotkov left the Main Military Provisional Party for the apparatus of the Russian Security Council and took Zhukova with him. And then she went into business, and Korotkov — first to the General Prosecutor’s Office and then to the Investigative Committee to Bastrykin. His relationship with Zhukova was no secret in management. Although they were not officially scheduled, they had a son in 2001 «- Yuri Malkovich, a former colleague of Zhukova and Korotkov, and later Zhukova’s business partner, told Novaya Gazeta. For some reason, the contract of purchase and sale of the apartment was also in the computer of the FLC lawyer. Firstly, because Greenwood, which provided the sister of a high-ranking official of the Ministry of Industry with 28.3 million rubles, had signs of a typical one-day company. The company did not pay insurance premiums to the Pension Fund, and when they tried to prosecute it for this in 2009, the court simply could not find its traces, because «the organization at the specified address does not appear.» And in 2010, the tax authorities excluded the company from the register of legal entities in Russia as inactive.

    And secondly, judging by the documents that were found in the FLC lawyer’s computer, it turned out that Kalamanova entered into a loan agreement for 28.3 million rubles in March 2008, and in May of the same year allegedly returned the entire amount in cash with interest to the cashier Greenwood.     And which of these ties is more valuable in Russia in the 21st century is still a big question. He negotiated meetings with former Defense Minister Anatoly Serdyukov; communicated closely with State Duma deputy Vladislav Reznik; received the information he needed from the deputy director of the Federal Drug Control Service (FSKN) Nikolai Aulov; paid medical expenses to Igor Sobolevsky, former deputy of Alexander Bastrykin in the TFR; conducted common business with the former deputy head of the Presidential Property Management Department, Ivan Malyushin, and with many, many others.     As Malyutin recalled, Burlakov invited him to work at FLC, but set a condition — to help the company win a state tender for the leasing of civil aviation. “Taking advantage of Gref’s location, I asked him to provide all possible assistance in promoting FLC to the competitive bidding”. “… At the same time, understanding the importance of the moment and in gratitude to Gref for his invariably kind and disinterested attitude towards me, I gave my personal guarantees that FLC, in case of winning the competition, will fulfill the terms of the transactions in the best possible way”, — Malyutin described his request to Gref. And FLC won the competition, and Malyutin was appointed deputy general director. According to him, in the office of the state company, he met Gagiev for the second time. But Burlakov this time for some reason presented him as «Valery Nikolaevich». Seeing Malyutin’s surprise, Burlakov explained: Gagiev is “from the special services and so it is necessary”, he was appointed from above — “the roof”. Malyutin worked in the company until 2004, then left, and in 2007 he returned as a director. Gagiev himself allegedly asked him about this. And, judging by the testimony of the «brothers», the state-owned company FLC became such a financial center of their «Family». “Malyutin provided all the guys I know, the guys from the“ Family ”. When Dzugutov was caught, Malyutin called, gave large sums of money, for which houses were rented for the guys [who were wanted] «, — said in court one of the «brothers», Dmitry Kodoev.

As it turned out later, 50 million euros for this deal were withdrawn from FLC. This money never returned to the state company. After the shipyards were bought, the Spanish police recorded a call from FLC director Nail Malyutin to Gennady Petrov: I hasten to report. The shipyards have been bought, — Malyutin happily informs.

    Well, thank God, — Petrov answers. And the stock jumped up. Did not have time to buy, there is already something to share. FLC owned 50% in FLC West, but then this share was sold for a penny to offshore companies. One of them was Cyprus-based Blackstead Holdings Ltd. She got 25% in the shipyards. Aslan Gagiev was a co-owner of Blackstead Holdings Ltd (he then used a passport in the name of Sergei Morozov). And 74% in the shipyards was received by the company from the British Virgin Islands Templestowe Trading Corp. She also provided almost 200 million euros for the purchase of Wadan Yards. This offshore company, as believed by the Luxembourg auditors, who subsequently prepared a report for the bankruptcy administrator of FLC, was controlled by Vitaly Yusufov and his father Igor. Tom Einertsen, one of the leaders of the shipyards, was of the same opinion. He was interrogated by the Norwegian police, to whom he explained: “Burlakov talked about how his goal in the purchase was to attract Russian orders and cooperate with Russian shipyards.

    I was told that he was investing 50 million euros, and the remaining money would come from another owner or a group of owners. It was said that this owner is Igor Yusufov. » Igor Yusufov at that time worked as the special representative of Russian President Dmitry Medvedev for energy cooperation. Igor Yusufov was interrogated in Russia. He confirmed that he had known Burlakov since 2008 — they were introduced by SVR General Alexei Korotaev. As a result of these thefts, FLC was unable to fulfill its obligations to foreign creditors. In Russia, law enforcement agencies opened a criminal case. And then the formal and informal leaders of the FLC began to present financial claims to each other. First, in March 2011, the “brothers” kidnapped Nail Malyutin.

    He was brought to a house near Moscow to Aslan Gagiev for a conversation. As members of the «Family» recalled in their testimonies, Gagiev reproached Malyutin for «stealing money from the company, stealing from Brother.» Malyutin said during interrogations that Gagiev began to beat him and make claims in connection with the fact that he fired his people, and the FLC was in a pre-bankruptcy state. And then he allegedly said that «he will not be able to explain to his people if he [Malyutin] leaves here alive.» But Malyutin was released. And a few days later he flew to Austria, from where he was then extradited to Russia. In May 2018, the Simonovsky District Court of Moscow sentenced Nail Malyutin to six years in prison for another episode of theft from the FLC. Malyutin, one might say, was lucky. In September 2011, his former partner and deputy, Andrei Burlakov, was killed in the Khutorok restaurant in Moscow. As one of the “brothers” Georgy Dzugutov said during interrogations, Gagiev was angry with Burlakov because he had stolen money from the company, disappeared and did not get in touch. Big Brother was looking for Burlakov for a long time.

    The former top manager of FLC was ruined by his love for expensive cars. At the end of June 2011, Dzugutov, along with another member of the «Family», was driving his car in the area of \u200b\u200bKrasnopresnenskaya embankment. And suddenly they saw a Bentley in dark blue. Burlakov had exactly the same car. They immediately turned around and drove off to get the Bentley. The car drove to the Khutorok restaurant near the Dynamo metro station. The one whom they had been looking for for so long came out of it — Andrey Burlakov. The brothers followed him for the next few months and found out that he often visits this restaurant. Yurtov went into the restaurant, made sure that Burlakov was in place, ordered tea, went to the toilet, put on gloves, left the toilet, took out a pistol and, a little before Burlakov’s table, began to shoot at him and Anna Etkina, who was sitting next to him, his common-law wife … Burlakov died from his wounds, and Etkina miraculously survived. A year after the murder, in 2012, FLC was declared bankrupt. State money left the company for shell companies that existed only on paper. And even if firms existed in reality, there was nothing to collect from them anyway. As, for example, from companies owned by a member of the «Family» Sergei Safronov. «Group Attache» — aka «distant base» — received from FLC 24 million rubles. Safronov cashed money from the accounts and never returned to FLC. Later, investigators found at the «distant base» only traces of blood from the corpses of the victims chopped to pieces.

    Sunset of the «Family» Robert Bagaev, nicknamed Robson, was put on the wanted list in 2009, because one of the “brothers” testified against him as an accomplice in the murder. In this regard, Robson went into an illegal position. “According to the established order in the“ Family, ”whoever was put on the wanted list lived in one of the houses rented by the“ Family ”specifically for this purpose. Those on the wanted list led a quiet lifestyle, did not appear in public places. The «Family» supplied everything necessary for life. While those on the wanted list lived in their dacha, «Family» prepared documents for them with changed personal data for traveling abroad «- Robson told investigators. As Bagaev recalled, around 2010, he and other «brothers» who were hiding from law enforcement agencies were suddenly urgently transported to another dacha in the Moscow region. Aslan Gagiev came to them and said that «family affairs are bad: Beglaryan and Nikolaev are crazy, they want to kill him and all of them, so we must find them first and kill them ourselves.» Ruslan Yurtov found Nikolaev and persuaded him to come and talk with Gagiev.

    The pioneer and Big Brother, according to eyewitnesses, talked all night. Gagiev asked Nikolayev why he wanted to leave the «Family» and kill the «brothers», and Nikolayev replied that he followed the lead of Sergei Beglaryan, Armen. Everything seemed to end well: Gagiev and Nikolayev embraced, and Big Brother suggested that Pioneer drive to the house where the wanted “brothers” lived in order to ask their forgiveness. And Nikolaev seemed to agree. But when they were leaving the base, the Pioneer suddenly started to run, shouting: «Help, police!» Apparently, he himself, more than once luring victims into a trap, decided that he was being taken to kill. But they caught up with him. Nikolaev was brought to the house where the «brothers» were hiding. They tied his legs with duct tape and left him and Yurtova in the gym. Gagiev gathered all the «brothers» who were in the house, and in their presence began to ask Nikolayev questions.

    «The pioneer confessed that he reported information about the ‘Family’ to the police, where he continued to work, and to their enemies,» — Bagaev recalled the conversation that lasted until the evening. Then, according to him, everyone went upstairs, and Gagiev listened to the opinion of each «brother» about what to do with Nikolayev. Robson and the other «brothers» went down to the gym. They killed Pioneer in the same way that he himself sent more than one victim to the next world — they put a plastic bag on his head and wrapped it in tape. Nikolaev was dying in front of the bound Yurtov. «After Nikolayev confessed that he was planning the murder of the» brothers «, suspicions arose about Yurtov, who was brought to the» Family «by Nikolayev and who was greatly influenced by Beglaryan»- recalled Bagaev. But Gagiev talked with Yurtov and decided not to kill him, Robson said. The next day Yurtov helped to dismember the body of his former «brother». The corpse was thrown out in the forest by the side of the road, and the severed body parts were burned. This was in December 2010. But in February 2011, the «brothers» realized that the snow had begun to melt and the corpse could be found.

    And they went to look for the body of the Pioneer hidden by them. They found the torso and buried it securely. For the second time, the body of a Pioneer (without a head, arms, legs), an employee of a top-secret department of the Ministry of Internal Affairs, was dug up by investigators in August 2015 — in a forest, at the 11th kilometer of the Moscow-St. Petersburg road, 70 meters from the roadside. After the murder of Nikolayev, the brothers hunted Sergei Beglaryan, one of the founders of the «Family», and the leader of the group, which included Nikolayev and Yurtov. Armenians were attempted twice. First, they lured him to a meeting and wanted to shoot him near the base on Lodochnaya Street, but both killers refused their weapons, and Beglaryan miraculously escaped the ambush. They were looking for him for two years, until in 2012 they recognized the house in which the Armenians were hiding. The brothers watched him at night at the entrance and literally riddled him with machine guns. The other «brothers» were not doing very well either. In the same 2012, Oleg Gagiev, nicknamed Malysh, a South Ossetian counterintelligence officer, was found guilty of seven murders and sentenced to life in prison. Yevgeny Yashkin, a former SOBR officer, was sent to compulsory treatment last year by the Moscow City Court: after all these murders, he suffered a psychiatric disorder — paranoid schizophrenia.

    His friend, a former criminal investigation officer, Ruslan Yurtov, is currently awaiting trial. From the remand prison, he sent a letter to Anastasia Burlakova, the daughter of the former deputy director of the FLC, who was killed by him. I think this letter is important, so I will quote it almost in full. The killer’s repentance “Thank you for allowing me to write this letter, despite the grief, misfortune and tears that you and your loved ones have experienced because of me! It is very important for me! I ask and I beg you to try to forgive me, please, forgive me, please, for your irreparable loss, for your suffering and tears, for taking away from you the most precious thing in life, your Pope. I understand that this is probably impossible. But I cannot do otherwise, I am very sorry and regret what I did, that brought grief to you and your loved ones. I cannot forgive myself for this and I have no right to do so, I will suffer and live with it all my life! I didn’t know and didn’t know your father, I didn’t want any harm to him or to the woman who was with him and to whom I am guilty no less than to you. I also want to beg her forgiveness.

    I swear that I did not want this, I tried to change something and somehow influence in order to avoid this tragedy. But forgive me for not being able to. I was forced, and I had no choice, I was not left with it, and I could not find a way out of this situation and the situation in which I myself, not willingly, found myself! I hate myself for all broken and spoiled lives, I hate myself and will never forgive myself. From the child’s letter, from suffering, I truly understand the depth of your grief, loss and misery, the wound that I have inflicted on you. I understand the hatred towards me as the person who deprived you of your Pope. I am not a cold-blooded and not cruel person, I have a heart that I love, a soul and a conscience that haunts me and torments me! Forgive me for everything, please! Yurtov Ruslan «. I think when Yurtov wrote this letter, he more than once recalled the day when he was faced with a choice — to take out Kipa’s decapitated corpse or refuse.

    The mortally wounded police colonel managed to ram one of the killers’ car that was blocking his way, but he could not escape the trap and died almost immediately. By the decree of the President of Russia, Mark Metsaev was posthumously awarded the Order of Courage. In the summer, bandits at one of the restaurants shot police major Ilya Kasradze. At the end of October, at the entrance to Vladikavkaz, Gagiev’s bandits shot from machine guns a car in which was the head of the criminal investigation department of the Ministry of Internal Affairs of the republic, Vitaly Cheldiev, together with his 20-year-old son Zaur. They both died on the spot. The bandits killed Metsaev and Cheldiev because they were actively fighting their group. Law enforcement officers tried several times to bring Bote and his bandits to justice, but Gagiev managed to avoid punishment each time. Bote several times ended up in a pre-trial detention center, and each time he was released. On November 26, the mayor of Vladikavkaz, Vitaly Karaev, was killed by killers at the gate of his own house. Karaev knew that they wanted to kill him, he even ordered an armored car for himself in Moscow.

    The driver who was supposed to deliver this car to North Ossetia was killed in Moscow. The bandits, knowing the schedule of the mayor’s movements, watched him from a nearby street, and when he and his bodyguards left the house, one of the gang members, Inal Ostaev, shot Vitaly Karaev with a sniper rifle. At the end of December of the same year, two bandits with machine guns blocked the exit from the yard of the car with the former Vladikavkaz mayor Kazbek Pagiyev, and when she stopped, they shot her. Together with the official, his driver was killed. In the spring of 2009, members of the gang seriously wounded police lieutenant colonel Aslan Kachmazov, who was investigating murders and other crimes organized by Malysh. In Moscow in 2004-2005, the owner of the National Capital bank Dmitry Plytnik, the unofficial owner of the Kredittrast bank Alexander Slesarev, and the chairman of the board of the Kutuzovsky bank Oleg Novoselsky were killed. Before his death, the swimmer was brutally tortured in a car wash room, wrapped in a nude film. After the banker signed a number of documents and blank sheets of paper, he was beheaded, and his body was thrown into the river with iron pancakes from a bar tied to it. His body was found in April 2005 on the shore in the Dubna area, he was identified only thanks to the DNA examination. Banker Oleg Novoselsky was concreted alive in a barrel. He died long and painfully: the barrel was kept for a long time in the basement of the office on Chistye Prudy, where Novoselsky was lured under the pretext of handing over fireworks to celebrate the New Year. Then the barrel with the corpse was thrown into the Moscow Canal, where it was found 10 years later by investigators by questioning one of the killers.

     

    INVESTIGATION, ARRESTS AND TRIAL

    Only after the high-profile murder of the mayor of Vladikavkaz, the investigators of the Main Investigation Department of the Investigative Committee of Russia for the North Caucasus and Southern Federal Districts, employees of the Ministry of Internal Affairs and the FSB of Russia joined the investigation. Alan Alborov, Inal Ostayev and a former employee of the Organized Crime Control Department Rafael Kalagov were arrested. Oleg Gagiev and Alexander Dzhussoev were detained in Moscow. Gagiev refused to cooperate with the investigation, Dzhussoev first gave evidence, but then refused them. Former police officer Givi Slonov, former deputy district prosecutor Murat Gabeyev, Inal Zasseev, Temur Kudziev, Ivan Bagaev and Robert Bagaev managed to escape and were put on the federal and international wanted list. Some of them were detained in August 2014, Aslan Gagiev — in January 2015 in Austria, Oleg Dzarahokhov and Ivan Bagaev — at the beginning of 2015 in Vladikavkaz and Montenegro, respectively, Artur Dzhioev — in April 2015 in Greece, officers of the SOBR Department of the Ministry of Internal Affairs of the Russian Federation in the Moscow region Andrey Sankin and Victor Pronin — in November 2015.

    Law enforcement agencies had to do a lot of work to collect evidence of the guilt of the bandits. For example, in order to find parts of the weapons dropped by the bandits in the Terek, it was necessary to drain the river bed near Vladikavkaz. During the investigation, witnesses were constantly threatened, and the investigators tried to compromise, including by spreading rumors about them on the Internet. Investigators were able to solve not only the murder of Vitaly Karaev, but also other crimes, including the murder of Kazbek Pagiev, former Deputy Prime Minister of the Government of the Republic of North Ossetia-Alania. Alan Alborov, Rafael Kalagov, Inal Ostaev and Alexander Dzhussoev were sentenced to lengthy prison terms. The trial of Oleg Gagiev took place in Rostov-on-Don, the defendant was guarded by riot police officers armed with machine guns. In March 2012, Gagiev was sentenced. Bote was found guilty of seven murders by the North Caucasian District Military Court and did not deserve leniency. Oleg Gagiev was sentenced to life imprisonment and a fine of one million rubles.

    On September 2, 2015, the North Caucasian District Military Court (the case was considered there, since one of the accused had the status of a serviceman during the commission of the crimes) sentenced six members of Gagiev’s gang for the murder of nine people: Oleg Khamitsev — to life imprisonment, Artur Tibilov — to 22 years , Chermen Sugarov — for 20 years, Valery Pliev — for 18 years, Tamerlan Kozyrev — for 17 years and Azamat Sidakov — for 16 years. Arrested in Austria, Aslan Gagiev was released on bail of 100,000 euros in March 2016 in the framework of the so-called Bulgarian case — during his arrest, he was found to have a fake passport of a Bulgarian citizen. In accordance with Austrian law, the accused, while awaiting extradition, cannot be detained for more than the term that threatens him in the country where he may be sent. In Bulgaria, he faced a year of imprisonment for using a false passport, but he had already served this time in an Austrian prison. At the same time, we are convinced that the materials of the preliminary and judicial investigation do not give a complete picture both about the criminals and victims themselves, and about the motives for committing crimes. They were carried out superficially, and the investigating bodies and the court did not set such goals for themselves, although in accordance with the norms of the criminal procedure legislation of the Russian Federation, this is their direct responsibility. It seems that the authorities are not profitable for the people to know the reasons and conditions, the conditions for the creation of groups of an organized group in North Ossetia (Vladikavkaz, Alagir, Beslan-Zilginsky) for the simple reason that this could reveal the true role of law enforcement agencies, which, due to their helplessness and criminal negligence, and sometimes corruption themselves are complicit in crimes. There was a widespread opinion in the society: “it was necessary to shoot all the corrupt officials and thieves”.

    This happens when the state, through its law enforcement agencies, ceases to establish order. Then there are «Unions» of men (OCG), which illegally take on the functions of «cleaners» of society from the dirt. » The purpose of our journalistic investigation is, on the basis of documents and court sentences, to reveal the conditions and causes, vitality and cruelty of organized crime groups, in order to work to eradicate and prevent them in the future. It sounds corny, but we do not want Vladikavkaz to become a gangster. This is our city, our families, our children live here, and we want to make our city safe, prosperous and attractive. For us, all sorts of «temporary guest performers» who come to receive titles and orders, to collect bribes — they will not bring order.

    Crime prevention is a whole science (criminology), which is studied in all law schools. There are also scientific centers. Unfortunately, science and practice in the activities of law enforcement agencies, the authorities as a whole still remain at the level of good wishes, and we are reaping power and criminal lawlessness.     This is understandable, because according to his position, Artur Akhmetkhanov should be the first to bear responsibility for the negligence of the “flourishing” — the mafia and the bond of power, business and crime on the territory controlled by his department. But instead of properly fulfilling his official duty, he began to perform the functions of a «secret political police», which is prohibited in the Russian Federation. Moreover, at someone’s order, he began to incite intra-ethnic hatred, inventing «Digor», «Iron» and «Kudar» ethno-clan groupings, allegedly trying to seize power in North Ossetia. It turns out that he saw his task not in the fight against crime, and in particular against organized crime, but in how to uncover and neutralize the “Digor clan,” supposedly creating the prerequisites for aggravating the operational situation. The minister and the customer of the «note» were not interested in the state of crime, but in the results of the upcoming elections. True, here the “friends” to whom A. Gagiev transferred his property and funds into management are actively trying to take possession of them.     We can say that they were respectable citizens — patriots of Russia and Ossetia, if they took part in the defense of the Fatherland, served in the special forces of the Ministry of Defense and the Ministry of Internal Affairs of Russia and the prosecutor’s office. Some of them received injuries and awards. Here, as common sense and logic shows, one could not do without an idea. It is to this circumstance that we tried to pay special attention during the journalistic investigation. As established, these young people came to the conclusion that after the Beslan tragedy, the main perpetrators of the murder of innocent citizens, including children, remained unpunished (some have already been written about, others will be discussed later). The perpetrators of the abduction of our compatriots, including children, with the aim of obtaining a ransom remained unidentified and not punished.

    They knew that many of those kidnapped for ransom had been secretly transported and held in the neighboring republic. That is, a stable trading scheme was established for our compatriots. Based on the facts on which the perpetrators were identified (for example, the case of the abduction and murder of Mirikov Ch.D. and the kidnapping of the child of entrepreneur L.L. Of course, these factors do not justify the criminals, but this happens in a state where its structures cease to perform the official functions assigned to them in a quality manner. The investigating authorities and courts do not want to take into account the stated circumstances, considering them tricks and the desire of criminals to evade responsibility. There is a popular saying: «It is customary to say only good or nothing about the dead.» However, it seems to us that we can say about everyone what he deserves, both during his lifetime and after. Our republic is small, everyone knows everything or almost everything about everyone.

    And everyone is free to give his or her own assessment of certain events and individuals. There is a version that the Vladikavkaz organized criminal group of Oleg Gagiev («Bote») was known to the local police from the moment of its organization. Moreover, up to five current police officers of the Ministry of Internal Affairs of the Republic of North Ossetia-Alania, three employees of the republican prosecutor’s office, one from drug control, one army officer were introduced and were members of an organized criminal group. Thus, it turns out that the Vladikavkaz OPG acted under the control of senior officials of the Ministry of Internal Affairs of the Republic of North Ossetia-Alania and other law enforcement agencies. So, part 1 of article 49 of the Constitution of the Russian Federation reads: “Everyone accused of committing a crime is presumed innocent until his guilt is proven in the manner prescribed by federal law and established by a court verdict that has entered into legal force.” Hence the conclusion: No one, including the Minister of Internal Affairs for North Ossetia-Alania A. Akhmetkhanov, has the right to consider Aslan Gagiev a criminal. Personally, I can testify on the basis of the materials collected during the journalistic investigation that there is no blood of his compatriots on the hands of Aslan Gagiev.
